TERMS AND CONDITIONS –TRIDENT ROTISERIES (UK) LTD- THE COMPANY

1. General  

(a) These terms and conditions shall apply to all the trading between The Company and the Buyer. Acceptance by The Company of your order is conditional upon acceptance by you of the following conditions which override all other terms and conditions inconsistent therewith express, implied or otherwise.

(b) Any variation of these conditions shall only be binding if agreed by a Director in writing. Any stipulation or conditions on a customer’s order form shall be deemed to be inapplicable to any order placed with us unless expressly agreed to by a Director in writing when acknowledging the order in question.

2. Acceptance of orders

In placing an order with the Company the Buyer confirms that they have read and understood all aspects of our Terms & Conditions

No binding contract shall be deemed to be effective until acknowledgment of your order and price is confirmed in writing by The Company & full payment is received

3. Price

a. Notwithstanding any offer, quotation, manufactures price list of website price, orders can only be accepted at the discounted list price in place at the date of dispatch

b. All orders are regarded as separate transactions & will be subject to small surcharges as appropriate i.e split deliveries to different addresses

c. All prices will be subject to V A T at the prevailing rate at date of purchase

4a Delivery

Deliveries will be made by the respective manufacturers, importers or their agents over a standard 2-3 working day service which is normally included in purchase price

In the unlikely event that the item you require is out of stock, then we will notify you immediately & give you the opportunity to either choose a replacement or to cancel your order

N.B Orders under £50.00 are subject to a £7.95 delivery charge to cover the suppliers post & packaging costs

Most suppliers/carriers apply a surcharge for deliveries to the Highlands, Islands & remote areas- the cost of which if applicable, will be confirmed prior to acceptance of order

Over night/next day delivery is available, this is subject to the time that your order is received as most suppliers have a ‘next day’ cut off point (usually around 2pm GMT)

Over night/next day delivery timeslots are available as follows
Before 10am- Before Noon- Before 6pm

All have varying costs which will be confirmed at the time of order

 

4b/Delivery and inspection of goods

Please note-Deliveries are made to your premises on the understanding that it is the Buyers responsibility to assist the driver, when off-loading heavy or fragile items and also to unpack and examine the consignment for any signs of transit damage

Deliveries will e made to the first point of access of the buyers premises on a ground level site (no steps or stairs)

N.B Drivers are not insured or contracted to enter your premises to assist with unpacking or positioning

However, this type of service can be provided if required and will be chargeable in accordance with the Supplier/Carries rates and conditions

The Buyer will be responsible for checking the delivery for any signs of damage BEFORE SIGNING THE DELIVERY ACCEPTANCE NOTE as neither the Suppliers, carriers nor the Company will be liable for any such damage unreported at the time of delivery

N.B Signing the Delivery Note as ‘unchecked’ is not acceptable and contravenes out Trading Terms and Conditions

In a situation where it is impossible to unpack the consignment whilst the delivery is still present e.g due to poor weather of traffic/parking conditions, then it is always advisable to sign the delivery note as DAMAGED, in order to cover any potential problems- however, any actual transit damage must be reported to both the Seller and the Carrier within 24 hrs of receipt of delivery this must be done in writing via either email or fax.

Unless otherwise agreed in writing our prices only cover delivery (and warranty work) on normal working days and during normal working hours. All deliveries made of work done at the customers request at any other times will be subject to extra charges

In the event of any goods, packaging or container being delivered and off loaded whether on the public highway or elsewhere at the buyers request, then the Buyer shall assume full liability for compliance with all H&S regulations and for all steps which need to be taken for the protection of persons or property and shall indemnify us in respect of all or any costs, claims, losses, or expenses which may be incurred as a result of the Buyers or their representatives instructions

Delivery dates are estimates only and the time of delivery shall not be the essence of the contract. We shall not in any event be liable to compensate the customer in damages or otherwise for any non delivery or late delivery of goods or for any loss consequential or otherwise arising there-from

Access & Returns
Please remember to measure all point of access before ordering, as the Company will not be held liable for any aborted delivery if any item is found to be too large for access into the Buyers Premises

NB: Any items returned for this reason will be subject to a Return/Restocking charge of 20% of the total order price plus the transport cost levied by the Supplier.
Any such goods must be returned  Unopened and Undamaged in the original packaging, with the Buyer having obtained an Order Return number from the Trident Sales office before returning the consignment.  The Buyer will also be given an estimate of the Return Transport cost at this time, all costs  of which they must agree/confirm in writing to sales@tridentuk.net within two working days from receipt of delivery.

Assuming that the Buyer has obtained the relevant  Order Return number within 48 hours of receipt of the delivery and that the goods have a cost price exceeding £200.00 +VAT,  then we/our Suppliers will accept the return of Unused,Undamaged,Unwanted goods that are NOT IN THE ORIGINAL MANUFACTURERS PACKAGING at a Restocking/Return cost to the Buyer of 40% of the cost price (OR £100.00) whichever is the greater amount.
It will be the responsibility of the buyer to arrange and pay for the return transportation, and to ensure that the goods are adequately palletised and/or packaged.
NB Any such goods found to be damaged upon return to Trident or our Suppliers will not be accepted/unloaded and will be returned to the Buyer/Sender `AS FOUND`.

SPECIAL ORDER OR BESPOKE  items are supplied purely on the basis that the Buyer has researched the product to ensure that it is fit for their requirements/purpose and it is understood that any such goods will be STRICTLY NON-RETURNABLE.
NB  An SPECIAL ORDER/BESPOKE items, ORDERED THEN CANCELLED prior to Manufacture/Importation will be subject to any Planning,Development or any other relative costs incurred by the respective Supplier or Manufacturer along with an Administration/Cancellation Fee of £ 250.00(+VAT) or 10% of the cost price whichever is the greater amount.


Re-stocking- The Company at its discretion may agree to the return of certain goods for any other reason provided that the goods are returned to the Company at the Buyers expense, unused, undamaged and in the original packaging, in which case the Buyer will be required to pay the Company a minimum 20% of the invoice value.

Items returned unused, undamaged without the original packaging will incur a re-stocking inline with the suppliers Terms, normally (40% of the original invoice)

Special order or bespoke goods are supplied at the request of the Buyer and are non returnable and potential claims as to the quality or non suitability for purpose of the goods supplied are solely at the Buyers risk

Where an order for any such good is cancelled prior to delivery, then the Buyer will be required to pay any cancellation charge levied by the Importer, Manufacture, or Supplier

No goods will be accepted for re-stocking unless the Buyer obtains a returns number from the Company prior to returning the goods

5/Warranty
All equipment is sold with a minimum 12 month parts & labour warranty except where displayed with special warranty terms such as ‘parts only’ or ‘back to base’ which normally allows for extra discount but will incur costs to the Buyer should any repair work be required

  • All ‘full warranty’ repair work is undertaken by the respective manufactures or their service partners & will be carried out within normal working hours (Mon-Fri 9-5.00) and be subject to their terms and scheduling
  •  Any Work carried out outside these hours, return visits or waiting time at the Buyer or their representatives request will chargeable at prevailing engineers rates, any payable ‘on the day’ or in some instances pre-payment will be required in line with the Manufactures Terms.
    N.B Problems and Faults not covered in the warranty include
  • Glass, Bulbs, Fuses, Door Seals, Bricks, Lime scale Ingress
  • Mis-use of equipment and dirty appliances
  • Improperly maintained
  • Incorrectly installed
  • Specification of equipment has been altered in any way after purchase by buyer
  • Under these circumstances there will be a charge for any repair work

    N.B-The Company accepts no liability for any loss of product due to any refrigeration failure.

 

6/English Law

Every contract to which these conditions apply shall be construed and operated as an English contract and in full acceptance with English Law and any disputers shall be submitted to the subscription of English Courts

Credit Card Security

All credit card numbers are encrypted in the software when the order is placed using 128 BIT encryption. They are only decrypted after they reach our computer. They are not held in any clear text on our Website.
